This agreement has been electronically executed between Mehmet Berk Uzunhasan (“Seller”) and the User (“Buyer”)who completes a purchase transaction through https://traintense.com/ regarding the sale of digital products.
This agreement regulates the purchase of digital products and services, the delivery conditions, and the rights and obligations of the parties regarding the Buyer’s purchase through the Seller’s website.
4.1. In service sales made through the website, the service is performed and delivered instantly according to its nature. In such a case, the invoice is sent to the Buyer via a permanent data storage tool.
4.2. Digital products are sent to the e-mail address specified by the Buyer during the purchase process within a maximum of 24 hours after payment confirmation.
4.3. These products are not subject to physical delivery, and there is no shipping option available.
4.4. A unique license key is provided to the Buyer. The license is limited to 2 devices and cannot be transferred, shared, or resold.
4.5. For MacOS users, the license key must be activated within 14 days from the purchase date. If the license key is not activated within this period, a new license key for second devices can be requested within a maximum of 60 days after the purchase. If this period is exceeded, no additional license key will be issued to prevent misuse.
6.1. The Buyer acknowledges that they have read and understood the essential characteristics of the product and services displayed on the website, including the sale price, payment method, and delivery information, and have provided the necessary electronic consent.
6.2. The Seller is responsible for ensuring that the product subject to the contract is delivered completely, in accordance with the specifications stated in the order, and with the user manuals.
6.3. If the digital product or service does not meet the specifications stated on the website due to a deficiency or technical error originating from the Seller, the Buyer may exercise one of the following rights:
6.4. These requests must be communicated to the Seller in writing or through electronic communication channels by the Buyer. The Seller is obliged to fulfill the necessary correction, update, or re-delivery of the product within a maximum of 14 business days from the receipt of the Buyer’s request.
6.5. As physical returns of digital products are not possible, the Buyer must not share or use their license key or product usage rights with third parties.
6.6. The Buyer acknowledges that they are responsible for knowing the features of the product at the time of contract formation and checking the technical requirements before purchasing. The Buyer is responsible for reviewing the product descriptions, verifying system compatibility, and contacting the Seller if support is needed.
6.7. Technical support requests that fall outside the scope of these provisions will be addressed through Traintense customer support services.
6.8. If the Buyer fails to make the payment for any reason, or if the transaction is canceled in bank records, the Seller is not obligated to deliver the product or service.
7.1. The Buyer acknowledges that they do not have the right of withdrawal due to the nature of digital products. In accordance with the Distance Sales Agreements Regulation, the right of withdrawal cannot be exercised for services that are instantly performed in an electronic environment and for intangible goods that are delivered immediately to the Buyer.
7.2. The Buyer is responsible for reviewing the product descriptions and system requirements before making a purchase. The suitability, system requirements, and functionality of the products must be assessed by the Buyer.
7.3. Due to the nature of digital products, which can be copied and reproduced, there is no return or refund policy.
7.4. Traintense is responsible for ensuring that purchased digital products function correctly and without errors. If a product does not meet the stated specifications or cannot be used due to a technical issue, the Buyer will be provided with an updated or error-free version of the product.
7.5. In case of technical issues, Traintense provides support through its communication channels. The Buyer may contact the Seller for product-related errors or technical problems and receive necessary technical support.
7.6. Traintense is not obliged to provide technical support for products that have had their code structure, functionalities modified, or page protections removed.
8.1. Events that are beyond the control of the parties and make it impossible to fulfill the obligations of the contract shall be considered force majeure events. (Examples: Natural disasters, war, cyber-attacks, legal regulations, internet outages, technical failures, etc.)
8.2. In the event of force majeure, the parties cannot be held liable for failing to fulfill their obligations.
8.3. If the force majeure event continues for more than 30 days, either party may unilaterally terminate the agreement.
9.1. Personal data of the Buyer is processed in compliance with the General Data Protection Regulation (GDPR).
9.2. The Buyer’s email and personal data will not be shared, sold, or used for commercial purposes.
10.1. In case of disputes, the Seller’s electronic records (such as computer or audio records) constitute conclusive evidence.
11.1. Any disputes arising from this contract shall be settled by arbitration or in the competent courts of the Seller’s country.
12.1. The Buyer declares that they have read, understood, and electronically accepted the terms of this agreement.
12.2. This agreement takes effect upon the Buyer’s completion of payment.

Bu sözleşme, https://traintense.com/ üzerinden gerçekleştirilen dijital ürün satışlarına ilişkin olarak, Mehmet Berk Uzunhasan (“Satıcı”) ile satın alma işlemini gerçekleştiren Kullanıcı (“Alıcı”) arasında elektronik ortamda akdedilmiştir.
Bu sözleşme, Alıcı’nın Satıcı’nın internet sitesi üzerinden yapmış olduğu dijital ürün ve hizmet satın alma işlemini, teslimat koşullarını ve tarafların hak ve yükümlülüklerini düzenlemektedir.

4.1. İnternet sitesi üzerinden hizmet satışlarında, hizmetin niteliğine göre anında ifa ve teslim gerçekleştirilir. Böyle bir durumda fatura kalıcı veri saklayıcısı aracılığıyla Alıcı’ya gönderilir.
4.2. Dijital ürünler, Alıcı tarafından satın alma işlemi sırasında belirtilen e-posta adresine, ödeme onayının alınmasını takiben en geç 24 saat içinde gönderilmektedir.
4.3. Bu ürünler fiziksel teslimata tabi olmayıp, herhangi bir kargo seçeneği bulunmamaktadır.
4.4. Alıcı’ya özel lisans anahtarı gönderilmektedir. Lisans, 2 cihaz ile sınırlı olup, devredilemez, paylaşılamaz veya yeniden satılamaz.
4.5. MacOS kullanıcıları için lisans anahtarı, satın alma tarihinden itibaren 14 gün içinde aktive edilmelidir. Lisans anahtarının süresi içinde aktive edilmemesi halinde, satın alım sonrası ikinci cihazlar için en fazla 60 gün içinde yeni lisans anahtarı talep edilebilir. Bu sürenin aşılması durumunda, suistimalin önüne geçmek amacıyla ek lisans anahtarı gönderimi yapılmamaktadır.

6.1. Alıcı, internet sitesinde gösterilen ürün ve hizmetlerin temel nitelikleri, satış fiyatı, ödeme şekli ve teslimatına ilişkin ön bilgileri okuyup, bilgi sahibi olduğunu ve elektronik ortamda gerekli onayı verdiğini kabul eder.
6.2. Satıcı, sözleşme konusu ürünün eksiksiz bir şekilde, siparişte belirtilen niteliklere uygun ve kullanım kılavuzları ile teslim edilmesinden sorumludur.
6.3. Sözleşmeye konu olan dijital ürün veya hizmetin, internet sitesi üzerinde belirtilen özellikleri taşımaması ve bu durumun satıcıdan kaynaklanan bir eksiklik veya teknik hata nedeniyle ortaya çıkması halinde, Alıcı aşağıdaki haklardan birini kullanabilir:
6.4. Bu talepler, Alıcı tarafından Satıcı’ya yazılı veya elektronik iletişim kanalları aracılığıyla bildirilmelidir. Satıcı, Alıcı’nın talebinin kendisine ulaşmasından itibaren azami 14 iş günü içinde ilgili düzeltme, güncelleme veya ürünün yeniden gönderilmesini gerçekleştirmekle yükümlüdür.
6.5. Dijital ürünlerde fiziksel iade mümkün olmadığı için, Alıcı’nın lisans anahtarını veya ürün kullanım haklarını üçüncü kişilerle paylaşmamış ve kullanmamış olması gerekmektedir.
6.6. Alıcı, sözleşmenin kurulduğu tarihte ürünün özelliklerini bildiğini ve teknik gereksinimlerini kontrol etmekle yükümlü olduğunu kabul eder. Satın alma öncesinde ürün açıklamalarını incelemek, sistem uyumluluğunu kontrol etmek ve destek ihtiyacı halinde Satıcı ile iletişime geçmek Alıcı’nın sorumluluğundadır.
6.7. Bu hükümler dışında kalan teknik destek talepleri, Traintense müşteri destek hizmetleri kapsamında karşılanacaktır.
6.8. Alıcı tarafından herhangi bir nedenle ürün/hizmet bedeli ödenmez veya banka kayıtlarında iptal edilir ise, satıcı ürünün/hizmetin teslimi yükümlülüğünde olmayacaktır.
7.1. Alıcı, dijital ürünlerin doğası gereği cayma hakkına sahip olmadığını kabul eder. Mesafeli Satış Sözleşmeleri Yönetmeliği uyarınca; elektronik ortamda anında ifa edilen hizmetler ve anında teslim edilen ürünler kapsamında, cayma hakkı kullanılamaz.
7.2. Alıcı, satın alma öncesinde ürün açıklamalarını ve sistem gereksinimlerini incelemekle yükümlüdür. Ürünlerin uygunluk durumu, sistem gereklilikleri ve işleyişi hakkında bilgi almak Alıcı’nın sorumluluğundadır.
7.3. İade politikası kapsamında, dijital ürünler doğası gereği kopyalanabilir ve çoğaltılabilir olduğundan ürün iadesi hizmeti bulunmamaktadır.
7.4. Traintense, satın alınan dijital ürünlerin doğru ve hatasız çalışmasını sağlamakla yükümlüdür. Eğer ürün belirtilen özellikleri taşımıyor veya teknik bir hata nedeniyle kullanılamıyorsa, Alıcı’ya güncellenmiş veya hatasız versiyonu yeniden sağlanacaktır.
7.5. Teknik destek gerektiren durumlarda, Traintense iletişim kanalları üzerinden destek sağlanmaktadır.Ürün kaynaklı hatalar veya teknik sorunlar için Alıcı, Satıcı ile iletişime geçebilir ve gerekli teknik desteği alabilir.
7.6. Ürün kod yapısı ve fonksiyonları değiştirilmiş ve sayfa korumalarının önüne geçilmiş ürünler için Traintense, teknik destek sağlamakla yükümlü değildir.
8.1. Tarafların kontrolü dışında gelişen ve sözleşme gerekliliklerinin yerine getirilmesini imkânsız hale getiren olaylar mücbir sebep olarak kabul edilir. (Örn: Doğal afetler, savaş, siber saldırılar, hukuki düzenlemeler, internet kesintileri, teknik aksaklıklar vb.) Mücbir sebep halinde, Taraflar edimlerini yerine getirememe nedeniyle sorumlu tutulamaz. Mücbir sebep durumu 30 gün boyunca devam ederse, taraflardan herhangi biri sözleşmeyi tek taraflı olarak feshedebilir.
9.1. Alıcı’nın kişisel verileri, 6698 Sayılı Kişisel Verilerin Korunması Kanunu (KVKK) ve GDPR kapsamında korunmaktadır.
9.2. Alıcı’nın e-posta adresi veya diğer bilgileri üçüncü taraflarla paylaşılmaz, satılmaz veya ticari amaçla kullanılmaz.
10.1. İşbu sözleşmeden doğabilecek her türlü uyuşmazlığın çözümünde satıcı kayıtları (bilgisayar, ses kayıtları gibi manyetik ortamdaki kayıtlar dahil) kesin delil oluşturur.
11.1. Bu sözleşme kapsamında çıkabilecek ihtilaflarda, Gümrük ve Ticaret Bakanlığınca ilan edilen değere kadar Tüketici Hakem Heyetleri, aşan durumlarda alıcının ve satısının arasındaki yerleşim yerindeki Tüketici Mahkemeleri ve İcra Müdürlükleri yetkilidir.
12.1. Alıcı, bu sözleşmenin tüm hükümlerini okuyup anladığını ve elektronik ortamda onayladığını beyan eder.
12.2. İşbu sözleşme, Alıcı’nın ödeme yaparak satın alma işlemini tamamlamasıyla birlikte yürürlüğe girer.
